29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) 3929 Woodlake Drive Bonita Springs, Florida - On or about March 19, 2024, the employer exposed employees to a 24 foot fall while standing on a second story roof overhang, spraying paint to a roof gable without fall protection.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) 3929 Woodlake Drive Bonita Springs, Florida - On or about March 19, 2024, the employer exposed employees to fall hazards in that, employees were not provided with a training program in the recognition of hazards associated with falls or procedures necessary to eliminate of minimize those hazards while conducting painting activities on a residential roof approximately 24 feet from the ground without the use of fall protection.
