29 CFR  1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about March 19, at 1114-1209 S 11th Street in Sheboygan, Wisconsin, employees were exposed to overhead struck-by hazards working in area with an excavator without using hard hats.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 19, at 1114-1209 S 11th Street in Sheboygan, Wisconsin, employees were exposed to struck-by hazards while using power tools without wearing eye protection.

29 CFR  1926.251(a)(6):  Rigging equipment for material handling.  "Inspections."  Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant.  Damaged or defective slings shall be immediately removed from service.   On or about March 19, at 1114-1209 S 11th Street in Sheboygan, Wisconsin, the employer did not ensure that a damaged four-legged sling used to hoist a trench shield was removed from service prior to employees working on the site.  No gate on a chain hook and gate not working on the swivel hoist hook.

Employers must ensure that rigging equipment has permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load.  On or about March 19, at 1114-1209 S 11th Street in Sheboygan, Wisconsin, the employer did not ensure that four-legged slings had permanently affixed identification and safe working load information on the chains.  Two slings available for use on the site.

29 CFR  1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about March 19, at 1114-1209 S 11th Street in Sheboygan, Wisconsin, an employee was exposed to crushing and struck-by hazards while working from inside an excavation at 5.5 feet deep without the spoil pile back two feet from the top edge.

29 CFR  1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift.  Inspections shall also be made after every rainstorm or other hazard increasing occurrence.  These inspections are only required when employee exposure can be reasonably anticipated.  On or about March 19, at 1114-1209 S 11th Street in Sheboygan, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the potential engulfment hazard associated with employees working from inside excavations at greater than 5 feet deep without using cave-in protection.
