29 CFR 1926.55(a)(2): Employees were exposed to a substance with a permissible exposure limit not preceded by (C) at concentrations above that specified in Table 1 of �1926.55 for that substance: a) On or about March 4, 2024, at 6390 W Indiantown Rd #43, Jupiter, FL 33458, an employee was exposed to an 8-hour time-weighted average (TWA) of 115.2 ppm of carbon monoxide at concentrations above the permissible exposure limit of 50 ppm for carbon monoxide specified in Table 1 of 29 CFR 1926.55 when working inside the facility while an EDCO DS-20-13H walk-behind gasoline-powered concrete saw was being used to cut concrete in the facility. b) On or about March 4, 2024, at 6390 W Indiantown Rd #43, Jupiter, FL 33458, an employee was exposed to an 8-hour time-weighted average (TWA) of 270.1 ppm of carbon monoxide at concentrations above the permissible exposure limit of 50 ppm for carbon monoxide specified in Table 1 of 29 CFR 1926.55 when working inside the facility using an EDCO DS-20-13H walk-behind gasoline-powered concrete saw to cut concrete.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) a) On or about March 4, 2024, at 6390 W Indiantown Rd #43, Jupiter, FL 33458, the employer did not develop, implement, and maintain at the workplace a written hazard communication program where employees were exposed to hazardous chemicals including, but not limited to, gasoline and carbon monoxide exhaust gas from the operation of an EDCO DS-20-13H walk-behind gasoline-powered concrete saw.
