29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, prior to the voluntarily use of elastomeric half mask respirator:  a.) Bradford Import Auto Sales dba Luv Toyota, on or about March 20th, 2024 and times prior thereto:  Employees voluntarily wore half mask air-purifying elastomeric respirators (3M brand #5300 series & 6300 with organic vapor cartridges) during work operations including, but not limited to the undercoating of automobiles. The employer did not ensure medical evaluations were performed prior to allowing employees to wear the elastomeric respirators.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a.)	Bradford Import Auto Sales dba Luv Toyota, on or about March 20th, 2024 and times prior thereto:  Employees voluntarily wore half mask air-purifying elastomeric respirators (3M brand #5300 series & 6300 with organic vapor cartridges) during work operations including, but not limited to the undercoating of automobiles. The company's written respiratory protection program did not contain specific elements to cover medical evaluations, respirator maintenance and care, and training associated with the respirator use.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Bradford Import Auto Sales dba Luv Toyota, on or about March 20th, 2024 and times prior thereto:  Employees voluntarily wore half mask air-purifying elastomeric respirators (3M brand #5300 series & 6300 with organic vapor cartridges) during work operations including, but not limited to the undercoating of automobiles. Employees that voluntarily used half mask respirators were not provided the information in Appendix D to this section.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). 29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  a.)	Bradford Import Auto Sales dba Luv Toyota, on or about March 20th, 2024 and times prior thereto:  Employees worked with and around hazardous substances including, but not limited to, Reistall Quick Dry undercoating and Sound Deadener during undercoating of automobiles.  The employers hazard communication program was lacking worksite specific information including, but not limited to the following:  1)  A list of the hazardous chemicals known to be present onsite. 2) The method the employer will use to provide employees with hazard communication training. 3) The hazard communication program referenced Material Safety Data Sheets throughout the documentation versus Safety Data Sheets.  In addition, the program did not demonstrate how employees would obtain access to the company's Safety Data Sheets. 4) Information regarding how labeling and other forms of warning for hazardous products would be conducted onsite.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

The employer did not provide site specific hazard communication training for all employees who worked with and/or around hazardous substances.
