29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  a)Talco Construction, LLC at 645 North Main Street, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards from the roof and awning areas, as well as a lack of training regarding scaffolding and ladders being used on site while conducting commercial roofing operations. This condition exposed employees to a variety of hazards identified on site.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  a)Talco Construction, LLC at 645 North Main Street, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the employer did not ensure that employees were protected from falls while conducting roofing work on a commercial property by an adequate fall protection system.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  a)Talco Construction, LLC at 645 North Main Street, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the employer did not ensure that training documentation was maintained regarding fall protection systems or how to identify/correct fall hazards prior to employees being exposed.  This condition exposed employees to fall hazards.
