29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems: (a)RJS Construction, Inc. at 2014 North Main Avenue, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the controlling employer did not ensure subcontractor employees were protected from fall hazards by guardrail systems, safety net systems, personal fall arrest system or warning line system and safety monitor system. Subcontractor employees were conducting re-roofing operations on a federal building with a roof pitch of 5-in-12 and up to 8-in-12 while not utilizing a fall protection system. This condition exposed subcontractor employees to a fall hazards from 10'7" to 28 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a)RJS Construction, Inc. at 2014 North Main Avenue, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the controlling employer did not ensure that the ladder on the west side of the building south of the front entrance being used for access onto the roof of a federal building was extended at least three feet above the upper landing surface of the roof. This condition exposed employees and subcontractor employees to a fall hazards. (b)RJS Construction, Inc. at 2014 North Main Avenue, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the controlling employer did not ensure that the ladder on the west side of the building north of the front entrance being used for access onto the roof of a federal building was extended at least three feet above the upper landing surface of the roof. This condition exposed employees and subcontractor employees to a fall hazards.
