29 CFR 1926.501(b)(11): Employees on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems: (a)Sergio Flores at 2014 North Main Avenue, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the exposing employer did not ensure employees performing roofing activities were protected from fall hazards. Employees were conducting re-roofing operations on a federal office building with a steep pitched roof of 5-in-12 and up 8-in-12 while not utilizing a fall protection system. This condition exposed employees to a fall hazards greater than six feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a)Sergio Flores at 2014 North Main Avenue, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the employer did not ensure that the ladder on the west side of the building south of the front entrance being used for access onto the roof of a federal building was extended at least three feet above the upper landing surface of the roof. This condition exposed employees to a fall hazards. (b)Sergio Flores at 2014 North Main Avenue, Spearfish, SD 57783: On or about and at times prior to March 20, 2024, the employer did not ensure that the ladder on the west side of the building north of the front entrance being used for access onto the roof of a federal building was extended at least three feet above the upper landing surface of the roof. This condition exposed employees to a fall hazards.
