(a) Oscar Reyes Siding & Roofing Inc. failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected: Citation 1, Item 1 a repeat violation of 29 CFR 1926.501(b)(13) with an abatement date of May 15, 2024. Citation 1, Item 2 a serious violation of 29 CFR 1926.452(k)(5) with an abatement date of May 15, 2024. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) On or about March 21, 2024, at an apartment complex located at 225 Riverview Dr, Thiensville, WI 53092, employees were conducting roofing and sheathing work on a two-story residential home and garage without the use of fall protection systems or equipment, exposing employees to fall hazards of approximately 9-13 foot fall from the top of the roof to the ground below. Oscar Reyes Siding and Roofing Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1534182, citation number 1, item number 2 and was affirmed as a final order on July 29, 2021, with respect to a workplace located at W62N616 Washington Avenue Cedarburg, WI 53012.

29 CFR 1926.452(k)(5): Scaffold platforms shall not be bridged one to another. (a) On or about March 21, 2024 employees conducting sheathing work on the roof of residential home and garage were using ladder jack scaffolding systems. The employer did not ensure proper set up of scaffolding platforms, scaffold platforms were bridged one to another exposing employees to an approximately 9-foot fall.
