29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition.  (a) Custom Building, 149 Industrial Drive, Building A - On or about March 21, 2024, the employer did not ensure that floors and elevated non-floor surfaces were maintained in a clean and orderly condition. Wood dust and shavings were allowed to accumulate on equipment, floors, overhead ductwork, and overhead natural gas air heaters exposing employees to potential fire, deflagration, and explosion hazards.  (b) Mold Building, 149 Industrial Drive, Building B - On or about March 21, 2024, the employer did not ensure that floors and elevated non-floor surfaces were maintained in a clean and orderly condition. Wood dust and shavings were allowed to accumulate on equipment and floors exposing employees to potential fire, deflagration, and explosion hazards.  (c) Rail Building, 174 Industrial Drive - On or about March 21, 2024, the employer did not ensure that floors and elevated non-floor surfaces were maintained in a clean and orderly condition. Wood dust and shavings were allowed to accumulate on equipment, floors, and appliances exposing employees to potential fire, deflagration, and explosion hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels:  An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by Amron Stair Works Inc.  a) Pine Box Building, 152 Industrial Drive - An employee performing stair building tasks including but not limited to operating a Whirlwind Cut-off Saw and a pneumatic fastener was exposed to continuous noise levels at 68.3% of the allowable 8-hour time-weighted average sound level (90 dBA).  The equivalent dBA level of 68.3% is approximately 87.2 dBA. The sampling was performed for 472 minutes during one 8-hour work shift on May 15, 2024.  Zero exposure was assumed for the unsampled period of time, 8 minutes.  The hearing conservation action level was established to prevent permanent loss of hearing.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   (a) Rail Building, 174 Industrial Drive - On or about March 21, 2024, the employer did not develop and implement a hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:   1) Requirement for labeling of containers of hazardous chemicals;  2) Safety data sheet availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be present in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employees were exposed to hazardous chemicals such as, but not limited to, Sunnyside Low-Odor Mineral Spirits (contains naphthalene).  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv):  (a) Rail Building, 174 Industrial Drive - On or about March 21, 2024, the employer did not train employees in at least the following:   1) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); 2) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; 3) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and,  Employees were exposed to hazardous chemicals such as, but not limited to, Sunnyside Low-Odor Mineral Spirits (contains naphthalene).  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical:   (a) Rail Shop - On or about March 21, 2024 - The employer failed to maintain a current copy of the safety data sheet for Sunnyside Low Odor Mineral Spirits (contains naphthalene). The available SDS, prepared May 20, 2005, was not in the 16-section format required by the Revised 2012 Hazard Communication Final Rule.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
