1910.9(b): Standards in this part requiring training on hazards and related matters, such as standards requiring that employees receive training or that the employer train employees, provide training to employees, or institute or implement a training program, impose a separate compliance duty with respect to each employee covered by the requirement. The employer must train each affected employee in the manner required by the standard, and each failure to train an employee may be considered a separate violation. On or before October 10, 2023, Respondent trained the subcontractor?s employees regarding the hazards involved while using energy control procedures, however, Respondent failed to ensure the subcontractor?s employees adhered to the training.

29 CFR 1910.269(d)(8)(iv):Whenever outside servicing personnel were to be engaged in activities covered by paragraph (d) of this section, the on-site employer and the outside employer did not inform each other of their respective lockout or tagout procedures, and each employer did not ensure that his or her personnel understand and comply with restrictions and prohibitions of the energy control procedures being used. Luminant Power, LLC on or about October 10, 2023, at the worksite located at 801 Carpenter Rd. in Defiance, Ohio: The employer did not inform an outside contractor of lockout/tagout procedures which would protect employees from hazardous electrical energy of the Unit 5 Generator Circuit Breaker, prior to a contractor performing maintenance operations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
