OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from unprotected edges: a) Jobsite located at 140 Sharp Rd. Avondale, PA: On or about March 21, 2024, employees performed tasks associated with removing mushrooms from the second level of the Mushroom House. Four employees performed these tasks while standing over an open hole in the floor of the second level measuring approximately 7 feet to the ground. Employees were not provided with a means of fall protection exposing employees to fall hazards from unprotected edges.

Avondale, PA.: On or about March 21, 2024, employees performed tasks associated with removing mushrooms from the second level of the Mushroom House. To access the second level, employees utilized a portable stairwell that was not equipped with stair railing and handrails, thereby exposing employees to fall hazards from unprotected edges.
