29 CFR  1910.28(b)(1)(i)(C): Protection from fall hazards. Unprotected sides and edges.  Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.  a) On or about March 20, 2024, the employer did not ensure that employees exposed to a fall hazard while working from a unprotected platform attach to Prime-Mover SN Electric Walkie Straddle Stacker Truck to pour products into the mix bowl at heights greater than 4 ft.  had a fall protection system in place.  Note:  the highest height that the platform can go is 52.5 inches. The sides measure at 48 inches and the length of the open area of the platform is 56 inches. The diameter of the bowl is 19.4 inches, causing an opening of 18.5 inches on each side of the platform when lifted.

Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  a) On or about March 20, 2024, the employer did not obtained manufactures prior written approval to install on the Prime-Mover SN Electric Walkie Straddle Stacker Truck a platform attachment which employees use to pour products into a large mix bowl.

29 CFR  1910.178(q)(6): Powered industrial trucks. Maintenance of industrial trucks. Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.  a) On or about March 20, 2024, the employer did not obtained manufactures approval, nor maintained original parts in that a solid piece of metal was added to the mast on the Prime-Mover SN Electric Walkie Straddle Stacker Truck in order to be able to move up and down the platform that carried products and employees.  b) On or about March 20, 2024, the employer did not obtained manufactures approval, nor maintained original parts in that an interior electrical gang box was attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck to connect additional attachments to the forklift battery power.

The driver shall be required to look in the direction of, and keep a clear view of the path of travel.  a) On or about March 20, 2024, employer did not ensure that the operator for the Prime-Mover SN Electric Walkie Straddle Stacker Truck had a clear view of the path of travel during operation in that employees were operating with a solid metal piece on the mast preventing a clear line of sight in the direction of travel.

29 CFR  1910.178(q)(1): Powered industrial trucks. Maintenance of industrial trucks. Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.  a) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was not removed from service in that the cord for the interior electrical gang box with knockouts capable of being removed attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck was energizing the walkie exposing employees to shock hazards when operating the lift in a forward and backward manner every time being use.   b) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was removed from service in that the interior electrical gang box attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck it was not installed and used for the gang box intended purpose of being placed inside of walls.   c) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck  was removed from service in that a flexible cord on the Prime-Mover SN Electric Walkie Straddle Stacker Truck had been spliced and taped.   d) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was removed from service in that the load/weight capacity nameplates on the Prime-Mover SN Electric Walkie Straddle Stacker Truck to show the equipment's load/weight capacity was inside a mechanical compartment and not visible to the operator.

29 CFR  1910.178(q)(7): Powered industrial trucks. Maintenance of industrial trucks. Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily to ensure that employees were utilizing it without any defects in that the interior electrical attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck was damaged in that employees are getting shocked when operating the lift in a forward and backward manner every time being use.    b) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily to ensure that employees were utilizing it without any defects in that the interior electrical gang box with knockouts on the sides attached to the Prime-Mover SN Electric Walkie Straddle Stacker Truck it was not installed and used for the gang box intended purpose of being placed inside of walls.   c) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily to ensure that cause of why employees utilizing it were receiving electrical shock in that a damaged flexible cord on the Prime-Mover SN Electric Walkie Straddle Stacker Truck had been spliced and taped.  d) On or about March 20, 2024, employer did not ensure that the Prime-Mover SN Electric Walkie Straddle Stacker Truck was examined before being placed into service at least daily in that employees were utilizing it without being aware of the load/weight capacity since the nameplates on the Prime-Mover SN Electric Walkie Straddle Stacker Truck was inside a mechanical compartment and not visible to the operator.
