29 CFR 1903.19(c)(1): Employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:   Location:   89 New Canaan Avenue, Norwalk, Connecticut  Abatement certification and verification for Citation 001, Item 01 and Citation 001, Item 02 with a final order date of  10/7/2024 was not received within 10 calendar days (by 10/17/2024) following the abatement due date (10/7/2024).

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels is not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  89 New Canaan Avenue, Norwalk CT: The employer routinely fails to ensure that workers on roofs with unprotected sides and edges 6 feet or more above the lower level are protected from falling, as required by the standard. This violation was observed on March 22, 2024, when the employer did not ensure fall protection such as personal fall arrest systems were utilized for the roofers on a high slope commercial roof performing roofing tasks more than 10 feet above the ground, and other times during multiple 501(b)(13) repeat-serious and serious violations of this standard by the employer.   JDC Construction, LLC was previously cited for a serious violation (second repeat) of the equivalent standard for the duty to have fall protection on a residential roof [1926.501(b)(13)], which was contained in OSHA inspection number 1449034, citation number 1, item number 1 and was affirmed as a final order on 05/08/2020, with respect to a workplace located at 1347 State Street, New Haven CT, 06511.  -OSHA previously issued a citation alleging a repeat-serious violation of the same occupational safety and health standard, or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1296111, inspection date 02/14/2018, citation 1, item 1, with respect to a workplace located at 12 Coppel Lane, Shelton CT, 06484.  -OSHA previously issued a citation alleging a serious violation of the same occupational safety and health standard, or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1079881, inspection date 07/23/2015, citation 1, item 2a, with respect to a workplace located at 104 Knoll Street, Waterbury CT, 06705.   Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance. (An abatement plan and periodic progress reports may also be required if the abatements period is more than 90 days).  This company failed to pay penalties and failed to comply with the applicable standards, and so the Secretary of Labor had to obtain an enforcement order under Section 11(b) of the Act in 2016 - see First Circuit Case No. 24-

29 CFR  1926.503(a)(1): The employer does not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   89 New Canaan Avenue, Norwalk CT: The employer routinely fails to ensure that workers are provided with a training program to  ensure compliance with fall protection requirements and does not designate any competent person to ensure that workers use appropriate fall protection. This violation was observed on March 22, 2024, when the employer did not ensure the onsite foreman on a roof over 10 feet above the ground without wearing fall protection was provided the proper training in recognizing and minimizing fall hazards, and multiple other times for repeat-serious and serious violations of this same standard by the employer.
