1910.146(c)(5)(ii)(A) Any conditions making it unsafe to remove an entrance cover shall be eliminated before the cover is removed. 29 CFR 1910.146(d)(3): Develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, 1910.146(d)(3)(i) - (d)(3)(vi). On or about March 8, 2024, at the facility located at 1955 Brunner Drive, Waupaca, Wisconsin, the employer did not ensure employees implemented the means, procedures, and practices necessary for safe permit space entry operations into the permit-required confined space Muller #5 (Model No.: GK C6838, Equipment No.: 10007285). The employer failed to ensure that employees isolated the permit space prior to entry by locking out the plow and related equipment and attempting to start the equipment to verify proper de-energization.

An employee failed to ensure the space was isolated prior to entry resulting in severe injury.

29 CFR 1910.243(b)(2): Airhose. Hose and hose connections used for conducting compressed air to utilization equipment shall be designed for the pressure and service to which they are subjected. On or about May 9, 2022, at the facility located at 1955 Brunner Drive, Waupaca, Wisconsin; the employer failed to ensure hose and hose connections used for compressed air were designed for the pressure and service for which they were subjected to. Specifically, employees were utilizing an air nozzle that was connected to the air hose using a worm gear clamp rather than a crimped fitting.
