OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards from the deficient design and/or implementation of preventative and/or protective measures in the Line 2 of Sheeting Department: a) Sheeting Department/Line 2 - On or about March 22, 2024, and at times prior, the employer exposed employees to fire hazards associated with combustible dust in the event of a deflagration or other uncontrolled fire event in that, although the Line 2 Sheeting Department was equipped with a dust collector, it was not properly removing accumulated combustible dust that was generated by Line 2 Sheeting Machines.

29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a) On or about March 22, 2024, and at times prior, the employer failed to inspect and remove accumulations of mannitol dust in the Sheeting Department/Line 2 area at an appropriate frequency and/or at least once per hour during product changeover operations to prevent dust accumulation sufficient to cause fire/slip hazards on walking/working surfaces.

29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of Total Dust listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 15 mg/m3 for Total Dust: a) Line 5 of Sheeting Department- On or about May 2, 2024, and at times prior, the employer exposed employees to respiratory hazards associated with Total Dust in that, the employer failed to ensure that employees operating the sheeting machine were not exposed to Total Dust in excess of the permissible exposure limit (PEL) at 15 mg/m3 which was calculated as an 8-hour time weighted average (TWA) of 29.8 mg/m3, during 467 minute sampling performed on 5/2/2024. Zero exposure was assumed for the 13 minutes not sampled.
