29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) On or about March 13, 2024, and at times prior, the employer, JA Holdings, LLC, dba Legend Auto Care & Customs, did not establish and implement a written respiratory protection program for employees required to wear N95 filtering face-piece respirators as well as air-purifying respirators with organic vapor or particulate matter cartridges. These conditions exposed employees to respiratory hazards. 29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) On or about March 13, 2024, and at times prior, the employer, JA Holdings, LLC, dba Legend Auto Care & Customs, did not develop a written hazard communication program to protect employees from hazardous chemicals. Among other chemicals, employees use ARA-H100 Hardener Topcoat Fast in spraying operations, which contains n-butyl acetate and hexamethylene diisocyanate. This condition exposed employees to hazards including, irritation and damage to eyes, skin, and upper respiratory system. JA Holdings, LLC, dba Legend Auto Care & Customs was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA Inspection 1703740, Citation 1, Item 2, which was affirmed as a final order on March 6, 2024, with respect to the workplace located at 521 Santa Fe Drive Pueblo, CO 81006.
