29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   a) On or about March 13, 2024, and at times prior, the employer, JA Holdings, LLC, dba Legend Auto Care & Customs, did not provide medical evaluations for employees required to wear N95 filtering face-piece respirators as well as air-purifying respirators with organic vapor or particulate matter cartridges.  These conditions exposed employees to respiratory hazards.

29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a) On or about March 13, 2024, and at times prior, the employer, JA Holdings, LLC, dba Legend Auto Care & Customs, did not establish and implement a written respiratory protection program for employees required to wear N95 filtering face-piece respirators as well as air-purifying respirators with organic vapor or particulate matter cartridges.  These conditions exposed employees to respiratory hazards.  JA Holdings, LLC, dba Legend Auto Care & Customs was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA Inspection 1703740, Citation 1, Item 1a, which was affirmed as a final order on March 6, 2024, with respect to the workplace located at 521 Santa Fe Drive Pueblo, CO 81006.

These conditions exposed employees to respiratory hazards. 29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valve:  a) On or about March 13, 2024, and at times prior, the employer, JA Holdings, LLC, dba Legend Auto Care & Customs, did not require air purifying respirators with P100 particulate matter filters to be stored in a manner which protected them from dust contamination.  These conditions exposed employees to respiratory hazards.  JA Holdings, LLC, dba Legend Auto Care & Customs was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA Inspection 1703740, Citation 1, Item 1c, which was affirmed as a final order on March 6, 2024, with respect to the workplace located at 521 Santa Fe Drive Pueblo, CO 81006.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a) On or about March 13, 2024, and at times prior, the employer, JA Holdings, LLC, dba Legend Auto Care & Customs, did not develop a written hazard communication program to protect employees from hazardous chemicals.  Among other chemicals, employees use ARA-H100 Hardener Topcoat Fast in spraying operations, which contains n-butyl acetate and hexamethylene diisocyanate.  This condition exposed employees to hazards including, irritation and damage to eyes, skin, and upper respiratory system.  JA Holdings, LLC, dba Legend Auto Care & Customs was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA Inspection 1703740, Citation 1, Item 2, which was affirmed as a final order on March 6, 2024, with respect to the workplace located at 521 Santa Fe Drive Pueblo, CO 81006.
