29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. a) 188 34th Street, Avalon, NJ - The employer did not ensure that employees conducting roofing operations (10:12 roof pitch), approximately 25 feet above the ground, had a fall protection system in place, thus exposing employees to fall hazards. This condition was observed on or about March 25, 2024. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the dates of the training, and the signature of the person who conducted the training or the signature of the employer: a) 188 34th Street, Avalon, NJ - The employer did not verify that employees had received fall protection training and completed a written certification record in accordance with the standard. This condition was noted on or about March 25, 2024. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
