OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards by motor vehicles when working in the roadway:   a. On or about March 21, 2024, the employer failed to ensure employees were protected from the recognized hazard of being struck-by motor vehicle traffic while working on a US Highway, which could likely cause death or serious injuries to employees. The employer tasked employees to remove gravel debris from U.S. Route 62, an active 55MPH two-lane roadway, without protecting employees from being struck-by motor vehicles traveling on the roadway.
