29 CFR  1926.100(a): Employees working in areas where there had been a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, had not been protected by protective helmets.  On or about March 27, 2024, D&C Installs LLC did not ensure that one worker, clearing debris from the ground-level, below roofing activities, was protected by a protective helmet from impact or falling objects in a worksite located at 1805 Mulligan Court in Wentzville, Missouri.

29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 27, 2024, D&C Installs LLC did not ensure that one worker, operating a pneumatic nail gun with wire-collated nails, was protected by appropriate eye protection from flying particles in a worksite located at 1805 Mulligan Court in Wentzville, Missouri.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels had not been protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor had the employer demonstrated that it was infeasible or created a greater hazard to use these systems and developed and implemented a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  On or about March 27, 2024, D&C Installs LLC did not ensure that six employees, roofing a residential building, were protected by protective guardrail systems, safety net systems, or personal fall arrest systems from falling 10 feet or more in a worksite located at 1805 Mulligan Court in Wentzville, Missouri.

29 CFR  1926.503(a)(1): The employer had not provided a training program for each employee who might have been exposed to fall hazards. The program had not enabled each employee to recognize the hazards of falling and had not trained each employee in the procedures to be followed in order to minimize these hazards.  On or about March 27, 2024, D&C Installs LLC did not ensure that six employees who were exposed to fall hazards from roofing a residential building located at 1805 Mulligan Court in Wentzville, Missouri had received training which would have enabled the employees to recognize fall hazards and trained them in the procedures to be followed in order to minimize fall hazards.

29 CFR  1926.59:29 CFR  1926.59: The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about March 27, 2024,  D&C Installs LLC did not develop, implement, and maintain at each workplace a written hazard communication program that at least described how the criteria specified in paragraphs (f) for labels and other forms of warning, (g) for SDSs, and (h) for employee information and training would be met. Employees were exposed to chemical hazards from utilizing gasoline to power air compressors for pneumatic nail guns. Employees were not trained about the information on hazardous chemicals in their work area, and an SDS for gasoline was not available to employees.
