29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  On or about March 28, 2024 the employer American Steel, LLC, at jobsite located at 32950 Pin Oak Pkwy. Avon Lake OH 44012, did not ensure that employee(s) operating a Genie Brand S-65 articulating mobile scaffold (aerial lift) donned and secured their personal fall arrest systems before operating the aerial lift. One employee was exposed to falls of 25 feet or greater to the ground below in that a fall protection harness and lanyard was not utilized by the employee when using the mobile scaffold to perform roof installation on a commercial steel erection construction jobsite.

29 CFR  1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.  On or about March 28, 2024 the employer American Steel, LLC, at jobsite located at 32950 Pin Oak Pkwy. Avon Lake OH 44012, did not ensure employees were protected from falls while performing roofing activities atop a low sloped commercial steel erection structure. Six employees installing metal roofing panels on the commercial structure were exposed to falls of 25 feet or greater to the ground below. The roof was a 2:12 pitch.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  On or about March 28, 2024 the employer American Steel, LLC, at jobsite located at 32950 Pin Oak Pkwy. Avon Lake OH 44012, did not ensure that employee(s) operating a Genie Brand S-65 articulating mobile scaffold (aerial lift) were trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

The employer shall institute a training program and ensure employee participation in the program. Avon Lake OH 44012, did not develop or maintain a written record of certification for all employees who might be exposed to fall hazards on steel erection sites.
