29 CFR 1910.95(c)(1):  A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA or a dose of 50%:    (a)Dakota Fiberglass, Inc. at 1720 Commerce Lane, Webster, SD 57274:  On or about and at times prior to March 6, 2024, employees were exposed to permanent hearing loss in that the employer has not developed and implemented a hearing conservation program including a monitoring program to quantify employee exposures to noise, employee notification of monitoring results, audiometric testing including baseline and annual audiograms, use of hearing protectors, training on the hazards associated with noise, and recordkeeping.  An employee was exposed to 70.4% dose with an 8-hour Time Weighted Average of 87.47 dBA exceeding OSHA Action Level of 50% dose and 85 dBA.  This condition exposed employees to hearing loss.
