29 CFR 1910.119(h)(3)(iv): The contract employer did not assure that each contract employee follows the safety rules of the facility including the safe work practices required by paragraph (f)(4) of this section such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel: (a)Preston Refrigeration Co., Inc. at 1400 North Weber Avenue, Sioux Falls, SD 57103: On or about and at times prior to March 27, 2024, the employer did not adequately implement safe work practices in that the company did not follow the host employer line break policy prior to breaking the line to remove Evaporator 0205 from the ammonia system. This condition exposed employees to anhydrous ammonia.

29 CFR 1910.119(e)(3): The process hazard analysis shall address the elements of (i) through (vii) of this paragraph: (a)Preston Refrigeration Co., Inc. at 1400 North Weber Avenue, Sioux Falls, SD 57103: On or about and at times prior to March 27, 2024, the employer did not ensure that employees conducting line break activities on Evaporator 0205 had conducted an effective process hazard analysis prior to line break activities being conducted. This condition exposed employees to anhydrous ammonia. (i) The hazards of the process; (ii) The identification of any previous incident which had a likely potential for catastrophic consequences in the workplace; (iii) Engineering and administrative controls applicable to the application of detection methodologies to provide early warning of releases. (Acceptable detection methods might include process monitoring and control instrumentation with alarms, and detection hardware such as hydrocarbon sensors.); (iv) Consequences of failure of engineering and administrative controls; (v) Facility siting; (vi) Human Factors; and (vii) A qualitative evaluation of a range of the possible safety and health effects of failure of controls on employees in the workplace.

29 CFR 1910.147(d)(4)(i):Lockout or tagout devices were not affixed to each energy isolating device by authorized employees: (a)Preston Refrigeration Co., Inc. at 1400 North Weber Avenue, Sioux Falls, SD 57103: On or about and at times prior to March 27, 2024, the employer did not ensure that lockout or tagout devices were affixed to each energy isolating device prior to conducting line breaking activities on Evaporator 0205. This condition exposed employees to anhydrous ammonia. The following energy isolating devices required a lockout device: (i) Hot gas stop valve VH101-2080; (ii) Solenoid valve VO103-0064; (iii) MVP stop valve VL101-0205; (iv) MVP solenoid stem valve; (v) Pump out valve VP101-2080; (vi) Vent valve VV102-0205; (vii) Safety relief valve (VF-101-0205)
