29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) 1344 Persian Ivy Way Dallas, GA: On or about March 29, 2024, and at times prior, the employer exposed employees to engulfment, struck-by and cave-in hazards, in that, the employer did not instruct employees to recognize and avoid unsafe conditions, including, but not limited to, the use of trench shields, failure to utilize the necessary personal protective equipment, and a lack of training and recognition of a safe means of access and egress procedures while performing work  at trench excavation site.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a)1344 Persian Ivy Way Dallas, GA: On or about March 29, 2024, and at times prior, the employer exposed employees to cave-in hazards, in that the employer did not ensure there was a safe means of egress for employees working in a trench. The trench measurement approximately 17-feet long, 11-feet wide, and 15-feet deep with a spoil pile located at the edge of the trench.
