29 CFR 1926.200(g)(2): The employer did not ensure that all traffic control signs or devices used for protection of construction workers conformed to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2009: On or about April 1, 2024, employees were exposed to struck-by hazards at or near 25688 Highland Rd., Richmond Heights, OH, 44143 where the employer did not have the following traffic control signs or devices in use to protect the crew that had one out of two lanes of traffic closed for new water pipe installation purposes on an active temporary construction zone: a) The employer did not ensure that traffic control devices were properly placed for a merging taper during a single lane closure on a multilane highway, according to Table 6C-4 Formulas for Determining Taper Length per the MUTCD. b) The employer did not ensure that traffic control signs were properly placed for a single lane closure on a multilane highway, according to Table 6C-1 Advanced Warning Sign Minimum Spacing per the MUTCD.

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices: On or about April 1, 2024, the employer did not ensure employees directing traffic at or near 25688 Highland Rd., Richmond Heights, OH, 44143 were protected from struck-by hazards, in that, the workers directing traffic were flagging from within the traveled way and were not using a stop/slow paddle, flag, or automated flagger assistance device as required per the MUTCD section 6E.07 and were not at flagger stations required by the MUTCD section 6E.08
