29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about April 1, 2024, on the East side of a newly built multi-family building, where employees were exposed to a fall hazard of more than ten feet when standing on a pallet elevated by a rough terrain forklift without using a personal fall arrest system or having a guardrail system in place.

29 CFR  1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  On or about April 1, 2024, on the East side of a newly built multi-family building, where two employees were exposed to a fall hazard when performing work from a wooden box placed on the forks of a Sany brand forklift, without the forklift being designed for such use.

29 CFR  1904.41(a)(2):29 CFR 1904.41(a)(2) Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. 29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  EACH 1910 STANDARD USED MUST INCLUDE "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)" at the end of the SAVE.  On or about April 1, 2024, on the East side of a newly built multi-family building, when an employee at the worksite was required to operate a terrain forklift without having been trained and evaluated to ensure they could do so safely.
