29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) to ensure that the operator who had been involved in an accident or near-miss incident, has the knowledge and skills needed to operate the powered industrial truck safely: a. On or about April 02, 2024, at 2999 NW 10th Street, Ocala, FL, 34475, an employee was operating a forklift with a frontend attachment/modification (fork extenders), to lift/move palletized loads of agricultural products from semi-trailers and to/from industrial steel shelving, wherein, the operator had been observed to operate the vehicle in an unsafe manner and/or the operator had been involved in an accident, during which time the employer failed to ensure that the forklift operator had received refresher training and a performance evaluation and/or failed to ensure that the operator's refresher training and evaluation was conducted by an "Experienced" person; therefore exposing the operator and the employees working/walking in the warehouse and storage yard to a crushed-by and struck-by hazards.
