29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. On a roof, at a temporary jobsite located at 411 Wood Bluff, in Saint Augustine Florida: On or about March 26, 2024, the employer exposed employees to fall injuries, in that the employer allowed employees to perform pool enclosures repairs activities at 6 feet (1.8 m) or more above lower levels without fall protection. OR IN THE ALTERNATIVE: 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.

On or about March 26, 2024, the employer exposed employees to fall injuries, in that employees performing activities related to pool enclosure repairs had not been trained to recognize the hazards of falling and /or the procedures to be followed in order to minimize these hazards.
