29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: (a) On or about April 4, 2024, located at W55n155 McKinley Blvd, Cedarburg, WI 53012, the employer did not ensure that periodic inspections of energy control procedures were conducted at least annually with authorized employees to ensure written and posted procedures were being followed while conducting servicing and maintenance on the Filler #6 (Federal 3010) machine. (b) On or about April 4, 2024, located at W55n155 McKinley Blvd, Cedarburg, WI 53012, the employer did not ensure that periodic inspections of energy control procedures were conducted at least annually with authorized employees to ensure written and posted procedures were being followed while conducting servicing and maintenance on the Filler #4 (Federal 26/8) machine.

29 CFR 1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (a) On or about April 4, 2024, located at W55n155 McKinley Blvd, Cedarburg, WI 53012, the employer did not ensure the employees implemented energy control procedures prior to initiating sanitation work on the Filler #6 (Federal 3010) machine. The machine was not isolated from all energy sources prior to engaging in this work, exposing employees to mechanical energy hazards from moving and rotating parts. (b) On or about April 4, 2024, located at W55n155 McKinley Blvd, Cedarburg, WI 53012, the employer did not ensure the employees implemented energy control procedures prior to initiating sanitation work on the Filler #4 (Federal 26/8) machine. The machine was not isolated from all energy sources prior to engaging in this work, exposing employees to mechanical energy hazards from moving and rotating parts. The employer did not ensure that energy control application steps were implemented as the equipment was not shut down and turned off to perform the sanitation work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout or tagout device application [1910.147(d)(4), stored energy [1910.147(d)(5), and verification of isolation [1910.147(d)(6), were not implemented to protect employees from mechanical energy hazards from moving and rotating parts during sanitation servicing.
