29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 3378 Rustic Trail, Delaware, Ohio: On or about April 1, 2024, and at times prior, the employer did not initiate and maintain safety and health programs related to the framing work that included work rules, hazard detection, and site safety enforcement. Employees were performing framing work utilizing pneumatic nail guns and portable circular saws without eye protection on the second story of a residential home at heights up to 13 feet without fall protection measures utilized and were utilizing an extension ladder unsafely, thereby exposing employees to fall and struck-by hazards.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at 3378 Rustic Trail, Delaware, Ohio 43015: On or about April 1, 2024, and at times prior, the employer did not ensure that employees performing residential framing work were provided with training on the recognition and avoidance of unsafe conditions including, but not limited to, fall protection/prevention, ladder safety, personal protective equipment, and safe use of tools. As a result, employees were exposed to fall hazards of approximately 13 feet and struck-by hazards associated with the framing work.

Located at 3378 Rustic Trail, Delaware, Ohio: On or about April 1, 2024, employees operated pneumatic nail guns and portable circular saws while performing framing work on a residential home being built from the ground level and second story floor without utilizing eye protection measures. As a result, employees were exposed to struck-by hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Located at 3378 Rustic Trail, Delaware, Ohio 43015: On or about April 1, 2024, employees were installing decking and framing in the second story floor of the residential home being built and working at unprotected edges without fall protection measures in use. As a result, employees were exposed to fall hazards of up to approximately 13 feet.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Located at 3378 Rustic Trail, Delaware, Ohio: On or about April 1, 2024, employees utilized a portable extension ladder to access the second story floor that they were framing that was not extended at least 3 feet above the upper landing surface nor were grabrails in use. Employees were thereby exposed to a fall hazard of approximately 13 feet.
