29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) On March 29, 2024 and times prior the controlling employer 307 Builders, LLC, did not ensure the framing sub-contractor provided training for their employees who operated and used a Caterpillar TL1150D telehandler with an attached work basket.  The sub-contractor's employees did not recognize or acknowledge the stability hazards when using the machine with the attached work basket.

29 CFR  1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178, and as referenced by the note contained in 1926.602(d).   a) On March 29, 2024, and at times prior the controlling employer, 307 Builders, LLC, provided the sub-contractors with a Caterpillar TL1150D telehandler with an attached work basket for use on the jobsite as needed.  The controlling employer did not ensure the sub-contractors protected their employees who were using and operating this machine with the attached basket, including training, evaluation, and certification.

29 CFR  1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  a) On March 29, 2024, and at times prior the controlling employer 307 Builders, LLC provided a Caterpillar TL1150D telehandler with a 14' x 4' work basket attached for sub-contractors to use as needed.  This basket was not approved by Caterpillar.  The controlling employer did not evaluate what effect the additional weight and overall length of the work basket would have on the rated lift capacity, the stability and safe operation of the machine.
