29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Employees were exposed to noise levels exceeding an 8-hour time weighted average of 85 decibels or equivalently a dose of fifty percent, without the employer administering a hearing conservation program:   a. A post tension machine operator was exposed to continuous noise at 70.7% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 87.5 dBA during the 464 minute sampling period on April 11, 2024; exposure calculations included a zero increment for the 16 minutes not sampled.  b. A shear operator was exposed to continuous noise at 71.7% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 87.6 dBA during the 446 minute sampling period on April 11, 2024; exposure calculations included a zero increment for the 34 minutes not sampled.  c. A shear operator was exposed to continuous noise at 101.7% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 90.8 dBA during the 438 minute sampling period on April 11, 2024; exposure calculations included a zero increment for the 42 minutes not sampled.

On or about April 3, 2024, on the west side of the building, employees were exposed to caught-in hazards when a rotating spool on the post tension cable machine was not guarded.  b.  On or about April 3, 2024, towards the middle of the building, employees were exposed to caught-in hazards when a rotating spool on the post tension cable machine was not guarded.  c..  On or about April 3, 2024, on the east side of the building, employees were exposed to caught-in hazards when a rotating spool on the post tension cable machine was not guarded.
