1926.20(b)(2): Frequent and regular inspections of the job sites, materials, and equipment were not made by a competent person(s) designated by the employer (i.e., a person who is capable of identifying exist):   On or about March 22, 2024, employees removing a wooden four-inch by six-inch by sixteen-foot (4"x6"x16') temporary power pole, using an Altec TA40  telescopic/articulating aerial device, from a commercial construction site at 501 5th avenue, Chardon, Ohio 44024 were exposed to a fall hazard of approximately eighteen to twenty feet (18'-20'). The employer's competent person did not inspect to ensure the necessary precautions were taken such as proper use of fall protection while performing work from the lift bucket.

1926.453(b)(2)(v) A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   On or about March 22, 2024, employees removing a wooden four-inch by six-inch by sixteen-foot (4"x6"x16') temporary power pole, using an Altec TA40 telescopic/articulating aerial device, from a commercial construction site at 501 5th avenue, Chardon, Ohio 44024 were exposed to a fall hazard of approximately eighteen to twenty feet (18'-20'), in that, a proper fall protection system was not used while performing work from the lift bucket.
