29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about April 4, 2024, and at times prior, employees were exposed to fall hazards of approximately 10 feet due to inadequate guardrail installation near the Komet shredder.  The employer failed to ensure the entire area was properly enclosed by a guardrail system. An area near the operator control station was missing a section of guardrail.

29 CFR  1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used:  On or about April 4, 2024, and at times prior, employees were exposed to fall hazards over 4 feet due to ladderway opening missing a swing gate. The employer failed to ensure the ladder opening from the fuel mezzanine was equipped with a swing gate or offset to protect employees from fall hazards into the pit area.

29 CFR  1910.146(c)(7)(iii): The employer did not document the basis for determining that all hazards in a permit space have been eliminated, through a certification that contains the date, the location of the space, and the signature of the person making the determination. The certification was not made available to each employee entering the space or to that employee's authorized representative:  On or about April 4, 2024, and at times prior, employees were required to enter a space marked permit required confined space which was reclassified by the employer prior to entry. The employer failed to document the basis for determining that all hazards in a permit space had been eliminated, through a certification that contains the date, the location of the space, and the signature of the person making the determination.

29 CFR  1910.178(m)(7): Brakes were not set and wheel blocks were not in place to prevent movement of trucks, trailers, or railroad cars while loading or unloading. Fixed jacks may be necessary to support a semitrailer during loading or unloading when the trailer is not coupled to a tractor. The flooring of trucks, trailers, and railroad cars shall be checked for breaks and weakness before they are driven onto:   On or about April 4, 2024, and at times prior, employees were required to enter trailers without checking the floors for breaks and weakness. Employees operate powered industrial vehicles and other machinery in the trailers to remove material and there was no policy to inspect trailers before entry to ensure no holes or weakness in the floor.
