29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at the job site at 708 S. Waverly Street, Columbus, Ohio 43213: On or about April 4, 2024, and at times prior, the employer did not ensure that employees were adequately trained on subjects including, but not limited to: trenching and excavation safety; usage and installation of cave-in protection; and safe operation of the Hitachi ZX85USB-5N hydraulic excavator. Employees were thereby exposed to serious injuries while performing plumbing and sewage work.

29 CFR 1926.602(a)(3)(i): No employer shall move or cause to be moved construction equipment or vehicles upon any access roadway or grade unless the access roadway or grade is constructed and maintained to accommodate safely the movement of the equipment and vehicles involved.  a. Located at the job site at 708 S. Waverly Street, Columbus, Ohio 43213: On or about April 4, 2024, and at times prior, the employer did not ensure that the Hitachi ZX85USB-5N hydraulic excavator was not operated on an unsafe grade or roadway in that an employee was operating the excavator over grade adjacent to an excavation that was undermined and beginning to collapse, exposing employees to a potential of tipping into the adjacent excavation, resulting in serious crushing injuries.

29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures.  a. Located at the job site at 708 S. Waverly Street, Columbus, Ohio 43213: On or about April 4, 2024, the employer did not ensure that pavements were not undermined or use a support system or other method of protection when they were undermined.  As a result, employees operated an excavator and worked at the edge of the excavation over the undermined section of the roadway, resulting in potential serious injuries from the collapse of the roadway into the excavation.
