29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  On or about April 4, 2024 the employer BMB Construction LLC at jobsite located at 41 Gone Fishing Ln. Lakeside/Marblehead OH 43440 failed to ensure that employees operating a powered industrial vehicle, Gradall 534D9-45 rough terrain forklift (S/N: 0744030) were adequately trained. Untrained forklift operators are hazardous to other employees working in the direct vicinity, such as not ensuring attachments are secured to the forks and overloading by attaching platforms that are too large for the lift, increasing the likelihood of struck by incidents, tipping and rollovers.

Lakeside/Marblehead OH 43440, did not have a plan or a program to identify job site hazards which assists employees in accident prevention and maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

Two employees were exposed to falls from approximately 12 feet or greater from the top of the second (roof) level to the decking below while using a Werner brand aluminum ladder to access the second (roof) level to perform residential framing activities.

One employee was exposed to falls of 10 feet and 9 inches (from the elevated scaffold pallet) or greater to the ground below while working from an unsecured wooden pallet to install construction framing material.

On or about April 4, 2024 the employer BMB Construction LLC at jobsite located at 41 Gone Fishing Ln. Lakeside/Marblehead OH 43440, did not ensure that each affected employee used appropriate eye or face protection when performing residential roofing and construction framing activities on a new build residential structure while exposed to potential struck by hazards (flying particles/debris) while using pneumatic nail guns. One employee was exposed to eye struck by hazards while installing shingles using a Bostitch brand pneumatic nail gun.  Another employee was exposed to eye struck by hazards while installing soffit framing material while using a Paslode brand pneumatic framing nail gun.  BMB Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard CFR 1926.102(a)(1) which was contained in OSHA inspection number 1611040, citation number one, item number one and was affirmed as a final order on October 19, 2022 with respect to a workplace located at 5061 Shepards Glen, Willoughby, OH 44094.
