29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about April 4, 2024, employees were exposed to the hazard of falling approximately 10 feet where a portable ladder did not extend at least 3 feet above the landing surface of a pitched roof. No abatement certification or documentation required for this violation.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) On or about April 4, 2024, employees were exposed to fall hazards while working without fall protection from a second story pitched roof having a ground to eave fall height of approximately 18 feet. b) On or about April 4, 2024, employees were exposed to fall hazards while working without fall protection from a first story pitched roof having a ground to eave fall height of approximately 12 feet. Bright Planet Solar, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 1649328, citation 1, item 2, and was affirmed as a final order on August 1, 2023, with respect to a worksite located at 1035 Maine Street, Haverhill, MA. Bright Planet Solar, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 1403267, citation 1, item 1, and was affirmed as a final order on August 21, 2019, with respect to a worksite located at 8715 Mobile Ave., Oak Lawn, IL. No abatement certification or documentation required for this violation.
