OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees are exposed to struck-by hazards involving damaged throat latches on the hooks of underhung chain hoists:  (a)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure employees were not exposed to struck-by hazards involving damaged throat latch on the 1/2-ton Dayton underhung electrically-powered chain hoist located in the lamination room (east side). The hoist was used to lift forms that create walls, floors and ceilings for recreational vehicles. This condition exposed employees to struck-by hazards.  (b)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure employees were not exposed to struck-by hazards involving damaged throat latch on the 1/2-ton Dayton underhung electrically-powered chain hoist located in the lamination room (west side). The hoist was used to lift forms that create walls, floors and ceilings for recreational vehicles. This condition exposed employees to struck-by hazards.  Among other methods, one feasible and acceptable method to correct this hazard is to follow the guidelines in ASME B30.17-2015 Cranes and Monorails (With Underhung Trolley or Bridge)and ASME B30.10-2019 Hooks, by ensuring cranes are properly inspected and hook latches are functioning properly.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to crushing hazards while using under-the-hook lifting devices not designed to meet criteria associated with ASME BTH-1 and ASME B30.20:  (a)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure the square lifting assembly used to set roofs on the walls of recreational vehicle trailer frames was designed by or under the direct supervision of a qualified person. The design shall be in accordance with ASME BTH-1 and shall consider the stresses resulting from the application of rated load plus the weight of the device to minimum design factor of three. The rigging system incorporated two overhead under-hung hoists in order to lift the roofs. One of the nylon straps used to hook to the roof assembly was frayed. The condition exposed employees using the rigging equipment to crushing hazards as a result of the lifting device failing.   (b)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure two swivel assemblies used to lift and rotate trailer frames were designed by or under the direct supervision of a qualified person. The design shall be in accordance with ASME BTH-1 and shall consider the stresses resulting from the application of rated load plus the weight of the device to include a safety factor.  The two steel swivels used to lift the frames were attached to the hooks of two overhead under-hung hoists. The swivel lifting apparatuses allowed employees to rotate the frames of the recreational vehicles. The condition exposed employees using the swivels to crushing hazards as a result of the lifting device failing.   (c)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure the swivel assembly used to rotate trailer frames and the square roof lifting assembly used to place roofs on the recreational vehicles, were rated prior to initial use. Both under-the-hook lifting assemblies did not have the rated load capacity marked or identification affixed listing the manufacturer's name, address, serial number and lifting device weight.   The condition exposed employees to crushing hazards as a result of the lifting device failing.   Among other methods, one feasible and acceptable abatement method can be found in the American Society of Mechanical Engineers, ASME B30.20-1.2.2 Construction, "Structural and mechanical lifting devices shall be designed to ASME BTH-1 Design Category B (static strength criteria) selected for its number of load cycles, unless a qualified person representing the owner, purchaser, or user of the lifting device determines and can demonstrate that ASME BTH-1 Design Category A is appropriate.  Design Category A shall only be designated when the magnitude and variation of loads applied to the lifter are predictable and do not exceed the rated capacity, where the loading and environmental conditions are accurately defined, service is not severe, and the anticipated load cycles do not exceed Service Class 0.  Among other methods, one feasible and acceptable abatement method can be found in the American Society of Mechanical Engineers, ASME B30.20 Below-The-Hook Lifting Devices, section 20-1.2.1 Marking, Rated Load-All new structural and mechanical lifting devices shall be marked with, but not limited to, the following information:  (1)    manufacturer's name and address (2)    serial number (3)    lifter weight, if over 100 lbs. (4)    rated voltage (when applicable) (5)    rated load (6)    ASME BTH-1 Design Category (7)    ASME BTH-1 Service Class

29 CFR  1910.135(a)(1): The employer did not ensure that each affected employee wore a protective helmet when working in areas where there is a potential for injury to the head:  (a)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure employees were provided head protection during the process of rotating the frames of recreational vehicles overhead. Two employees used two overhead chain hoists to lift the frame of a recreational vehicle and rotate it to continue the manufacturing process.  This condition exposed the employees to struck-by hazards.

29 CFR  1910.243(c)(3): Abrasive wheels used on vertical portable grinder(s) (right angle head grinders) were not provided with safety guard(s) having a maximum exposure angle of 180 degrees and located between the operator and wheel:   (a)TM Industries, LLC at 24221 412th Avenue, Artesian, SD 57028: On or about and at times prior to April 4, 2024,  the employer did not ensure the Dewalt D23402 handheld angle grinder was equipped with a guard while employees were grinding parts on the frame of a recreational vehicle.   This condition exposed employees to struck-by hazards associated with grinding operations.

29 CFR  1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) were not visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket):  (a)TM Industries, LLC at 24211 412th Avenue, Artesian, SD 57314: On or about and at times prior to April 4, 2024, the employer did not ensure that electrical equipment was free from recognized hazards involving an extension cord set in that a 12-gauge extension cord was used to provide power to a Dewalt handheld angle grinder and had approximately five inches of the insulation removed with the inner conductors exposed. This condition exposed employees to electrical shock and burns.
