29 CFR  1926.1101(f)(2)(i): Initial Exposure Assessment. Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.  a) On or about March 24, 2024 in Building 28 Room 218, an initial exposure assessment was not conducted for asbestos by a competent person for pipefitters removing copper pipes covered in asbestos-containing TSI.

29 CFR  1926.1101(g)(1): Methods of compliance. Engineering controls and work practices for all operations covered by this section. The employer shall use the following engineering controls and work practices in all operations covered by this section, regardless of the levels of exposure: (ii) Wet methods, or wetting agents, to control employee exposures during asbestos handling, mixing, removal, cutting, application, and cleanup, except where employers demonstrate that the use of wet methods is infeasible due to for example, the creation of electrical hazards, equipment malfunction, and, in roofing, except as provided in paragraph (g)(8)(ii) of this section; and (iii) Prompt clean-up and disposal of wastes and debris contaminated with asbestos in leak-tight containers except in roofing operations, where the procedures specified in paragraph (g)(8)(ii) of this section apply.  a) On or about March 24, 2024, in Building 28 Room 218, wet methods were not used to control the pipefitters exposure to asbestos-containing TSI during handling, removal, and cutting while removing pipes with TSI in that wet methods were only used after the asbestos was disturbed.

In addition to the requirements of paragraph (g)(1) of this section, the employer shall use the following control methods to achieve compliance with the TWA permissible exposure limit and excursion limit prescribed by paragraph (c) of this section; (ii) Enclosure or isolation of processes producing asbestos dust;  (iii) Ventilation of the regulated area to move contaminated air away from the breathing zone of employees and toward a filtration or collection device equipped with a HEPA filter;  a) On or about March 24, 2024 in Building 28 Room 218, the employer did not use control methods such as enclosures and ventilation of the regulated areas to comply with the 8 hour TWA of 0.1 fibers/cc and excursion limit of 1 fiber/cc for asbestos for pipefitters removing piping coated in asbestos-containing TSI.

29 CFR  1926.1101(h)(1)(i): General. For employees who use respirators required by this section, the employer must provide each employee an appropriate respirator that complies with the requirements of this paragraph. Respirators must be used during: Class I asbestos work.  a) On or about March 24, 2024, in Building 28 Room 218, the employer did not provide respirators for Class I asbestos work in that respirators were not provided for pipefitters when cutting down pipes insulated with asbestos-containing TSI.

29 CFR  1926.1101(h)(3)(i): Respirator selection. Employers must: (A) Select, and provide to employees, the appropriate respirators specified in paragraph (d)(3)(i)(A) of 29 CFR 1910.134; however, employers must not select or use filtering facepiece respirators for use against asbestos fibers. (B) Provide HEPA filters for powered and non-powered air-purifying respirators.  a) On or about March 24, 2024 in Building 28 Room 218, employers did not select and provide appropriate respirators with HEPA filters for pipefitters removing pipes insulated with TSI in that no respirators were provided.

29 CFR  1926.1101(k)(9)(i): Employee Information and Training. The employer shall train each employee who is likely to be exposed in excess of a PEL, and each employee who performs Class I through IV asbestos operations, in accordance with the requirements of this section. Such training shall be conducted at no cost to the employee. The employer shall institute a training program and ensure employee participation in the program.  a) On or about March 24, 2024, the employer did not train pipefitters in accordance with sections 1926.1101(k)(9)(ii), (iii), and (viii),  in that they had not been trained to remove Class I asbestos, and the trainining was not performed annually and initially. Pipefitters removed piping covered in asbestos-containing TSI.
