OSH ACT of 1970 Section (5)(a)(1) : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: At 2950 Lake Guntersville Pk Drive Guntersville, AL 35976: On or April 2, 2024, and at times prior, the employer?s employees were exposed to struck-by, caught-between and crush-by hazards, in that the employer failed to maintain copies at the worksite of inspections performed by the specialized contract provider retained by the employer to perform all maintenance and inspections of the E-Crane Series 700 Model 4248-PD-E, SN E040716-BE031-US material handler used to remove corn from barges at the worksite. Among other methods, feasible means of abatement would be for the employer to maintain at the material handler or worksite copies of all inspection records performed by its specialized contract provider.

29 CFR 1910.179(j)(1)(ii): The employer did not perform frequent and periodic inspections as defined in paragraphs (a) and (b) of this section: At the Guntersville Lake, 3500 Lake Guntersville Pk Drive Guntersville, AL 35976 : On or April 2, 2024, and at times prior, the employer exposed employees to struck-by, caught-between and crush-by hazards, in that the employer failed to perform frequent and periodic inspections while the crane E-Crane Series 700 Model 4248-PD-E, SN E040716-BE031-US was used to remove of bulk material such as corn from barges. The employer failed to perform frequent and periodic inspections, such as but not limited to: 1. Wind speed meter (Anemometer) 2. Load charts 3. Load Moment Indicator (LMI) system - overload system 4. Travel Units 5. Central Lubrication 6. Swing gears 7. Swing drives 8. Hydraulic system (cylinders, hoses, pumps and motors, pressure settings) 9. Oil cooler 10. Main electric motors 11. Steel construction (bolts and nuts, hydraulic and electrical tubing)
