29 CFR 1910.178(l)(1)(ii): The employer did not ensure each operator had successfully completed the required training by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck:  On or about April 3, 2024, at the lubricant distribution facility at 515 Short Street in Palmyra, Missouri, employees utilized powered industrial trucks to transport totes, barrels, and pallets. The employer did not ensure employees had received the required training and evaluation prior to operating a Yale GLP05OUX and a Hyster 50 industrial trucks.  The employees were exposed to struck-by hazards from the equipment and materials.

29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s):   On or about April 3, 2024, a Hyster 50, powered industrial truck was operated at 515 Short Street in Palmyra, Missouri. The Hyster 50 was being operated with a non-functioning horn, backup alarm and a broken alignment pin for the liquified petroleum gas tank. Employees were exposed to struck-by and fire hazards.

29 CFR 1910.303(b)(8)(i): Electrical equipment was not firmly secured to the surface on which it was mounted:  On or about April 3, 2024, in the bulk room at 515 Short Street in Palmyra, Missouri. The employer did not ensure the electrical junction box with 240-volt conductors for transfer pump #2 was secured to the cart frame. The junction box was placed in a basket located near the oil discharge nozzle and rags saturated with oil. The employees operating the equipment in this area were exposed to shock hazards and fire hazards.

29 CFR 1910.305(b)(1)(i): Conductors entering cutout boxes, cabinets, or fittings were not protected from abrasion and openings were not effectively closed:  On or about April 3, 2024, in the bulk room at 515 Short Street in Palmyra, Missouri. The employer did not ensure the 240-volt conductors running into a electrical junction box were protected from abrasion. The conductors power pump #1 which transfers AW32/AW68 hydraulic oil. The employees working in the area operating the equipment were exposed to shock hazards.

29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes and panelboard enclosures in damp or wet locations were not installed to prevent moisture or water from entering and accumulating within the enclosure:  On or about April 3, 2024, in the bulk room at 515 Short Street in Palmyra, Missouri. The employer did not ensure junction boxes and receptacle boxes were designed for exposure to wet or damp locations in the following areas:   a. On the Southwest corner of the building near the rolling bay door a set of receptacle were located on a structural beam. A  Mi-T-M industrial pressure washer was plugged into one of the outlets.  Located approximately 4-6 inches away from the electrical receptacle boxes was a water spigot.  The receptacles contained 120 and 240 volt power exposing employees to shock and electrocution hazards when working in the area using the pressure washer.   b. In the bulk room, the junction boxes used to control 240-volt power for pumps used to transfer liquids were not designed for wet or damp locations.  The boxes were not designed to prevent intrusion of liquids which were prevalent in this environment.  Employees were exposed to shock and electrocution hazards while working in the area and manipulating the 30-amp breaker.
