1910.178(l)(4)(ii)(E) A condition in the workplace changes in a manner that could affect safe operation of the truck. OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while working in and around damaged storage racks: On or about April 4, 2024, employees were loading and unloading pallets from storage racks throughout the warehouse and were exposed to struck-by hazards due to damaged or missing components of the storage racks including, but not limited to: Rack(s) 1-5, 8-11, 14, 16, 19, 20, 26, and 31.
