29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) On or about April 8, 2024, at the facility, employees wearing half face elastomeric respirators to transfer catalyst pellets had not received medical evaluations. Catalyst Trading Co Ltd was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.134(e)(1), which was contained in OSHA inspection number 1652034, citation number 1, item number 1-b and was affirmed as a final order on June 13, 2023, with respect to a workplace located at 7518 Avenue North, Houston, TX 77012.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: a) On or about April 8, 2024, at the facility, where the employer permitted employees to wear facial hair while requiring the use of elastomeric half-face respirators while transferring catalyst products throughout the facility.
