The employer failed to provide certification of abatement for the citations related to the lack of written certification that a workplace hazard assessment had been performed, lack of a written respiratory protection program, lack of employee medical evaluations, and improper respirator storage and protection that were issued on September 4, 2024.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  On or about April 16, 2024, at location 5523 W Integrity Way, Appleton, Wisconsin: the employer did not establish and implement a written respiratory protection program with worksite-specific procedures.  The employer required employees to wear respirators when sanding and painting metal shipping containers.    All provisions of 29CFR 1910.134(c) through (o) must be covered in a respiratory protection program.  Key elements include, but are not limited to the following:      1.  Selection of respirators for employees.     2.  Medical evaluations for employees.     3.  Fit testing.     4.  Training and information.     5.  Recordkeeping. Respirators were observed hanging from a hook in the garage adjacent to the main assembly area. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about April 9, 2024, at location 5523 W Integrity Way, Appleton, Wisconsin: The employer did not provide employees with effective information and training on hazardous chemicals in their work areas at the time of their initial assignments. Employees were not trained on the hazards of the chemicals that they worked with, nor were they trained on the availability or location of safety data sheets (SDS).  Employees worked with chemicals such as Acetone, Naphthalene, Toluene, and Xylene and were not trained on the hazards such as flammability and possible health effects such as kidney and liver damage of said chemicals.  All provisions of the hazard communication standard's training paragraph 29 CFR 1910.1200(h) must be effectively trained to employees.
