29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) (AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)): On or about April 9, 2024, and at times prior, at 8083 West Oakland Park Blvd, Sunrise, Florida 33351, an employee was operating a powered industrial truck (i.e. SkyTrak model 6042, serial number 0160114147) without being trained and evaluated, exposing himself and other employees to struck and caught by hazards.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about April 9, 2024, and at times prior, at 8083 West Oakland Park Blvd, Sunrise, Florida 33351, two employees were exposed to a 30-foot fall hazard while working in a balcony with an open sided edge on the fourth floor of a residential building under construction.
