The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  (a) On or about April 9, 2024, located at 641 South Main Street, West Bend, WI 53095, the employer failed to ensure employees tasked with performing tear-off and replacement of a roof on the two-story residential home had received fall protection training to be able to recognize hazards of falling associated with the job, exposing the employees to a fall hazard of approximately 20 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) On or about April 9, 2024, located at 641 South Main Street, West Bend, WI 53095, the employer failed to ensure the ladder used to access the balcony on the back of the residential home extended at least three feet above the upper landing surface, exposing an employee to a fall hazard of approximately 11.5 feet.

29 CFR  1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:  (a) On or about April 9, 2024, located at 641 South Main Street, West Bend, WI 53095, employees were exposed to fall hazards when accessing the balcony to remove shingles that had fallen onto the balcony during tear off of the existing roof.  Employee had to step down approximately 42 inches from the guardrail to the balcony platform, and the employer did not ensure a stairway or ladder was provided to all personnel points of access where there was a break in elevation of 19 inches or more.
