29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a) 405 Barnegat Rd Manahawkin, NJ: An employee was observed working at heights of approximately 7 to 8 feet above the ground while on a pallet suspended in the air by a Lull Highlander Telehandler Serial #19040. The pallet was not an approved attachment or device for the employee to operate from. Observed on or about 04/09/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(c)(2)(v):Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a) 405 Barnegat Rd. Manahawkin, NJ 08050: An employee was observed working at heights of approximately 7 to 8 feet above the ground while on a pallet suspended in the air by a Lull Highlander Telehandler Serial #19040. The pallet was being used as a scaffold and was not attached to the telehandler by chain, locking mechanism, or any form of restraint. Observed on or about 04/09/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
