OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of being struck-by polyvinyl chloride (PVC) pipe in the event of rupture. (a) At 6513 116th Avenue North, Largo, Florida, on or about April 10, 2024; polyvinyl chloride (PVC) pipe was used exposed above ground to transport compressed air at 30 psi for the operation of pneumatic machines / equipment, exposing employees to a struck-by hazard.

(b) at 6513 116th Avenue North, Largo, Florida, on or about April 10, 2024; employees were exposed to struck-by hazards, in that, the point of operation on the ACCU Model AC3KY Manual Mill, Serial # 874009 and the Bridgeport were not guarded, exposing employees to a struck-by hazards created by the cutting motion of the tool.
