29 CFR  1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.   CCMA - The employer has assessed the workplace and determined that employees are required to wear personal protective equipment (PPE).   PPE such as hearing protection devices and eye protection have been provided but a signed, dated, and written certification has not been prepared.  Employees are exposed to health and physical hazards while working in regulated areas containing naturally occurring asbestos (NOA), applying pesticides, or operating equipment such as chain saws, earth moving equipment, and UTV's.

29 CFR  1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard")  CCAS - The employer did not provide a respirator user with the information contained in Appendix D as required.  The employee had been donning a 3M, half-face, tight fitting respirator to protect himself against overspray and organic vapors while spray painting a fuel tank.  The employee is potentially exposed to cardiovascular and respiratory hazards.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user.  CCAS - The employer provided an employee with a 3M, half-face, tight fitting respirator for voluntary use prior to medical clearance. The employee uses the respirator when spray painting and working in regulated, NOA areas.   The employee is potentially exposed to cardiovascular and respiratory health hazards.

29 CFR 1910.134(g)(1)(i)(A): The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function.   CCAS, yard - On 8/7/24, an employee was donning a 3M, tight fitting respirator to protect against the health hazards associated with organic vapor generated while spray painting a fuel tank.  The employee has facial hair preventing a proper seal.  The employee was potentially exposed to the health hazards of organic vapors.
