On or about April 9, 2024, at the worksite located at N5793 Old Lake Road, Shawano, Wisconsin; the employer did not address construction hazards by having frequent and regular inspections of the worksite by a competent person to ensure workers were following company and OSHA safety regulations to include the use of fall protection. Workers were exposed to fall hazards at a jobsite where a competent person had not adequately inspected the work areas to address and eliminate hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   On or about April 9, 2024, at the worksite located at N5793 Old Lake Road, Shawano, Wisconsin; workers were performing reroofing activities on an approximately 5:12 pitch roof, without any form of fall protection, while exposed to an approximate nine-foot, three-inch fall.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
