29 CFR  1926.416(a)(1):  Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:   a) On April 12, 2024, employees performing carpentry and demolition work were exposed to electrical hazards while working in close proximity to a live residential power drop.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

No abatement certification or documentation is required for this item.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were the employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) On April 12, 2024, employees were exposed to fall hazards of up to approximately 9.2 feet while performing carpentry and roofing work to an existing structure.  b) On April 12, 2024, employees were exposed to fall hazards of over six feet from an uncovered floor hole leading to the basement below.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  Dominic McGee dba Dominic McGee was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1626267, citation number 1, item number 2, and was affirmed as a final order on January 18, 2023, with respect to a workplace located at 435 N Merrill Street in Park Ridge, Illinois.
